4 Myths about Red Light Cameras

Florida drivers are noticing that they are encountering more traffic cameras.

These high-tech devices are meant to catch drivers in the act of an infraction like speeding, running a red light or failing to stop for an adequate time.

At Estrella Ticket Defense, we have traffic ticket attorneys Miami citizens call when they get a letter that has a picture of them allegedly breaking the law. Many drivers make the mistake of thinking that because the court has a picture, there is no reason to fight the ticket.

Any experienced Miami speeding ticket lawyer will argue that this is not the case. That’s why Estrella Ticket Defense wants to debunk four myths about red light cameras.

Myth 1: You’re Immediately Guilty

The court has a picture that allegedly shows you breaking the law, so you’re automatically guilty, right? Wrong. Red light cameras malfunction, and maybe it wasn’t even you behind the wheel. Other circumstances can contribute to your innocence. You need Estrella Ticket Defense to fight for you.

Myth 2: You Don’t Need to Worry If You Don’t Speed or Run Red Lights

Even cautious drivers may get a ticket from a red light camera when it makes a mistake. Don’t just pay that ticket.

Myth 3: Tickets From Cameras Don’t Show Up on Your Driver’s Record

If you pay within 30 days, then the ticket won’t go on your record. However, it will go on your record if you delay paying.

Myth 4: Failure to Stop Completely While Making a Right Turn Means You’re Automatically Guilty

The traffic ticket attorneys Miami drivers trust remind you that you don’t have to stop completely for a right turn if doing so is “reasonable and prudent.” You’ll need a qualified Miami speeding ticket lawyer from Estrella Ticket Defense to make this argument.

The One Thing You Shouldn’t Do After Getting a Traffic Ticket – Forget About It

Most of us are incredibly busy. That’s what makes it so easy for things to slip our minds. However, the one thing you should never do after getting a traffic ticket is: forget about it.

As the traffic ticket attorneys Miami drivers rely on, Estrella Ticket Defense has heard it all. We’ve helped clients who have gotten a ticket while they were hurrying to a job interview or even on the way to the hospital with a pregnant wife. Other client stories are much more mundane.

However, as any experienced Miami speeding ticket lawyer will say, forgetting about a ticket is a huge mistake. If you fail to pay the ticket or show up in court on the appointed day, the consequences get worse. You could be facing additional fines or a license suspension. Worse, sometimes a judge will issue a warrant for your arrest.

As the traffic ticket attorneys Miami residents have come to trust, Estrella Ticket Defense is here to remind you that you have options when you get a ticket. Here are your main choices:

1. Pay the Ticket

At Estrella Ticket Defense, we rarely recommend that clients take this route. It’s the same as a guilty plea, which is a black mark against your driving record. If you already have some tickets, then you just moved one step closer to a suspension.

2. Pay the Ticket and Go To Traffic School

Now you’ve not only got a guilty plea against you, but also you lose your free time in traffic school. There’s a better way to handle the situation.

3. Fight the Ticket

Fighting a ticket is easier than you think, especially when you have a Miami speeding ticket lawyer on your side. Even if the ticket doesn’t get dismissed, we may be able to help in other ways. Call Estrella Ticket Defense today.

6 Things To Know About Traffic Tickets

Do you need a traffic ticket lawyer?

At Estrella Ticket Defense, we work hard to keep Florida drivers on the road. Part of the job of any speeding ticket lawyer is to educate the public about driving infractions and how they can affect your record. In fact, most people don’t realize that an unpaid ticket can affect their entire life in unexpected ways. If you have received a citation, then you need to speak with a traffic ticket attorney at Estrella Ticket Defense today.

Here are six things that everyone should know about traffic tickets.

1. Too Many Points Leads to Suspension

Did you know that if you get 12 points on your record in a 12-month period that your license could be suspended? A speeding ticket lawyer can attest that this is an extremely common problem for Florida drivers.

2. Toll Violations Are More Serious Than You Think

The state takes tolls seriously. If you fail to pay a toll when it is due, then you could be on the hook for triple the toll or even more. Some drivers may even have their privileges suspended over unpaid tolls.

3. You Can Dispute a Red Light Camera Ticket

Most drivers think that there’s no use fighting a red light camera ticket, but a speeding ticket lawyer knows otherwise. Cameras do make errors, and you can fight the citation.

4. Traffic Violations May Be Criminal Offenses

Most driving infractions result in a simple ticket, but others carry criminal charges. One of the most common of these is driving with a suspended license. Don’t put yourself in danger of being prosecuted in criminal court.

5. Your Traffic Ticket Attorney Can Take Care of Everything

When you hire a ticket lawyer, they can appear in court on your behalf. You can stick to your normal routine.

6. You Can avoid Points on Your Record

Do you have too many points? At Estrella Ticket Defense, we may be able to help you avoid any additional points your record. This may mean that your next citation won’t result in the suspension of your license.

How A Traffic Ticket Attorney Can Help You Beat A Speeding Ticket In Miami

Believe it or not, you do have a choice when you get a traffic ticket in Miami. Most people think that they’ll just have to pay the fine and accept the extra points on their license. The reality is that, if you send in your request for trial instead, you just might be able to fight and beat that ticket.

That is especially true when you hire Miami traffic ticket attorneys like the practitioners at Estrella Ticket Defense. It is possible for you to fight a traffic ticket by going to court yourself, but there are significant drawbacks to doing so.

For instance, you’ll have to spend a great deal of time preparing your case. Then, you are all-but guaranteed to have to spend a full day going to court. That means that you’ll have to take a day off of work or away from your other responsibilities, and you may not even win your case.

Without being familiar with how traffic court works, which evidence you should gather and how you should present it, the process is loaded with pitfalls. You could waste a lot of time and effort and have nothing to show for it.

It’s different when you hire Estrella Ticket Defense to help you. For a surprisingly affordable fee, we’ll handle the entire process for you from beginning to end. We’ll listen to your side of the incident, and gather all of the pertinent evidence needed to prevail in court.

We’ll attend the pretrial hearing on your behalf. We may even be able to settle the proceedings then and there. If that doesn’t work, then we’re prepared to take your case to trial. With our proven success rate, you can rest assured that we will get a more positive outcome than you could have gotten for yourself.

When to Hire a Traffic Ticket Lawyer

Most people who receive a traffic ticket don’t think twice about just paying it. Getting the ticket is irritating enough; fighting it in court has got to be a nightmare.

However, in most cases, it is in the driver’s best interest to enlist the services of a traffic ticket lawyer. That’s because paying the fine is the same as pleading guilty in a court of law. That black mark on your record can follow you, resulting in higher insurance rates and the possibility for even greater penalties for subsequent tickets.

Traffic ticket defense just makes sense

In the vast majority of cases, traffic ticket defense just makes sense. What most people don’t understand is that almost everything in relation to a traffic ticket is negotiable as long as you have the time, knowledge and determination to fight. A traffic ticket lawyer can sometimes get a ticket completely dismissed, but even if that isn’t a possibility, getting a reduced fine, avoiding traffic school and keeping points off of your record are all valuable incentives.

Estrella Ticket Defense has built a practice out of helping people improve their situation after receiving a ticket. They understand that a simple moving violation can have huge consequences for some drivers. The traffic court defendants we help range from people who might lose their job or their license because of a ticket to people who just don’t want that blemish on their perfect driving record. Whatever reason you have for wanting to fight a ticket, Estrella Ticket Defense stands ready to provide the legal knowledge you need.

Hiring a traffic ticket lawyer opens up numerous possibilities

Drivers make the mistake of thinking that their options are limited after they get a ticket. The reality is that hiring a traffic ticket lawyer opens up numerous possibilities, all of which are more attractive than pleading guilty by paying the fine. Experienced traffic court attorneys are able to do this because they understand the intricacies and technicalities that can affect your ticket. Their familiarity with traffic laws, combined with their knowledge of the various law enforcement agencies that write tickets to motorists, make them adept at negotiating a more advantageous outcome for their clients.

Most people don’t realize that one small error on the ticket or in the circumstances surrounding the incident can lead to the violation being dismissed or reduced. This is where the knowledge and experience of a traffic court attorney become indispensable. They can look for and exacerbate the small errors that the police overlooked and that the prosecution will ignore unless an attorney builds a traffic ticket defense that points it out.

The reality is that cities, counties and states are looking to boost revenue with the proceeds of traffic ticket fines. This means that the fines for moving violations have increased rapidly in recent years. What’s more, police are more likely to ticket drivers for lesser infractions than they were just a decade ago. The result is more tickets written and more revenue for the municipality, but drivers can protect themselves by hiring a lawyer to handle their case.

Estrella Ticket Defense handles your moving violations so you don’t have to. In most cases, we can appear in court on your behalf, which means that you are free to go about your usual routine without interruption. Hiring an attorney to handle your traffic ticket is just a smart thing to do when it’s vital for you to avoid adding points to your license.

What Happens When You Get a Speeding Ticket in Florida?

Speeding tickets

The consequences for getting a speeding ticket in Miami can be surprisingly far reaching and expensive. Drivers who already have a few tickets on their record are facing the possibility of having their license suspended. That can be especially bad news for someone who must have a valid driver’s license for their job.

On top of the danger to the license, there are the significant costs involved. The fine itself, the court fees and the expense of getting the license reinstated can add up surprisingly fast. Long-term consequences are possible too. Insurance rates can skyrocket, and subsequent tickets could end up costing even more.

Florida is known for its strict laws regarding moving violations. That is why it’s critical to work with an experienced speeding ticket lawyer. The seasoned professionals at Estrella Ticket Defense are prepared to fight to keep you on the road and to keep more money in your pocket.

In Florida, every speeding ticket and moving violation is given a point value. That value can range from three to six, depending upon the seriousness of the particular violation. For instance, speeding at about five miles per hour over the limit may only get you three points, but if you’re caught going 25 miles an hour over the speed limit, you may get more.

Having too many points is bad news for Florida drivers. If you accrue 12 points in any 12-month period, then your driving privileges could be suspended for 30 days. A total of 18 points in any 18-month period could mean a suspension lasting for three months. If you are unlucky enough to earn 24 points in a 36-month time frame, you could be looking at a suspension of one year.

Clearly, accumulating too many points carries some pretty heavy consequences. It’s a situation that habitual speeders may find themselves in more than once. Fortunately, the driver can tell the court that they will attend traffic school. Although this means loss of free time and the requirement to pay the fine and some surcharges, traffic school does keep points off of your record. This basically means that you didn’t plead guilty. As a result, your insurance rates won’t go up. That’s a pretty fair trade for losing about four hours of time but you must keep in mind that traffic school can only be elected once per year and only five times in your lifetime.

Miami-Dade Expressway to start billing for tardy tolls

The Miami Herald

Some drivers who use Miami-Dade Expressway Authority toll roads without SunPass may be in for a surprise in April when they begin receiving their first bills in six months. That’s because in October the Expressway Authority (MDX) stopped sending monthly bills to drivers who pay tolls using the system known as Toll-by-Plate. In that system, a camera photographs the license plate of a vehicle when it crosses an electronic collection point. A bill of all Toll-by-Plate charges is then sent every 30 days to the registered owner of the vehicle.
