What To Do When You Get A Red Light Camera Ticket In Miami

Red Light Camera Ticket In Miami

When someone gets a red light camera ticket in Miami, drivers can either pay the fine or hire an attorney to fight it. When first issued, a red light camera ticket is called a “Notice of Violation”. The fine isn’t too steep, around $158.00, and Florida does not add points to your driver’s license for paying a “Notice of Violation”. However, it may be that a camera malfunction or other problem renders that ticket unenforceable.

A red light camera ticket is generated when a car triggers a camera at an intersection. The vehicle passes over a sensor that is activated when the light is red. A photograph is snapped of the license plate and the vehicle, as well as a short video of the alleged violation, then the “Notice of Violation” is mailed to the registered owner of the vehicle. If the “Notice of Violation” is not paid by the due date on the notice, then the ticket is converted to a “Uniform Traffic Citation” and with it a steeper fine and 3 points to your license. If the driver was not the registered owner, then the owner should not be responsible for the fine. It may be necessary to go to court have the ticket issued in the driver’s name.

It may be that the device wasn’t working properly at the time of the photograph. The burden is on the police and the prosecution to demonstrate that the camera was working as it is supposed to at the trial. If they cannot do this, then the ticket can be dismissed.

There may be other circumstances in which such a ticket can be dismissed or that the fine can be reduced. Any red light ticket Miami drivers receive may be worth taking to a traffic ticket attorney.
